Gravity Field Platform
1. General terms and conditions.
- 1.1. Gravity Field - FZCO (License number 32348), hereinafter referred to as "Gravity Field", retains all right, title and interest, including without limitation any and all Intellectual property rights in and to the Gravity Field Platform, hereinafter referred to as "Platform", as well as to all improvements, updates, upgrades, error-corrections or other modifications, all materials posted on https://gravityfield.ai, whether or not they are available to the public domain.
- 1.2 Use of the Platform shall be in accordance with these Terms of Use, hereinafter referred to as the "Terms", the Privacy Policy https://gravityfield.ai/privacy-policy/ and the Service Level Agreement https://gravityfield.ai/sla/.
- 1.3. Any individual who is not a sole proprietor, starting to use the Platform, including its specific functions, shall be deemed to have accepted the Terms, as well as the terms of other documents specified in clause 1.2 of the Terms, without any reservations or exceptions.
- 1.4 The use of the Platform, including the use of its specific functions, by legal entities and sole proprietors is carried out on the basis of an agreement/contract with Gravity Field. Legal entities and sole proprietors who have started using the Platform, including the use of its specific functions, shall be deemed to have accepted the Terms, as well as the terms and conditions of other documents specified in clause 1.2 of the Terms, without any reservations or exceptions.
- 1.5 Any individual who is not a sole proprietor, starting to use the Platform, including the use of its individual functions, confirms that he/she has full legal capacity. If an individual does not have full legal capacity, he/she is not entitled to use the Platform, including its specific functions. The use of the Platform, including its specific functions, by individual who is not a sole proprietor, is limited to viewing, subscription to the newsletter, downloading, printing of information, provided that the use is limited exclusively to personal, informational or non-commercial purposes.
- 1.6. Legal entities, sole proprietors, individuals who are not sole proprietors are collectively referred to as "Users" in clauses 1.7 to 3.6 of the Terms.
- 1.7 These Terms and the documents referred to in 1.2 of the Terms may be amended by Gravity Field without any special notice to Users. The new version of the Terms and the documents specified in clause 1.2 of the Terms shall take effect from the moment of their posting on the Internet at the addresses specified in clause 1.2 of the Terms, unless otherwise provided by the new version of the Terms and the documents specified in clause 1.2 of the Terms.
- 1.8. If the User does not agree with the provisions of the Terms and the documents specified in clause 1.2 of the Terms, the User may not use the Platform, including its specific functions. If the User does not agree with the changes made by Gravity Field to the Terms and/or the documents referred to in clause 1.2 of the Terms, the User shall cease using the Platform.
- 1.9. The law of the United Arab Emirates shall apply to these Terms and to the relations on the use of the Platform. Any claims or lawsuits arising out of the Terms and the documents specified in clause 1.2 of the Terms or the use of the Platform shall be filed and considered in court at the location of Gravity Field.
2. Use of the Platform. Individual functions of the Platform.
- 2.1. The Platform shall be used solely for the User's legitimate and bona fide purposes.
- 2.2. The User undertakes not to use the Platform in any manner that is or may be harmful to the Platform, or in any manner that is illegal, fraudulent, damaging in any way to the Platform and/or third parties, or in connection with any illegal, fraudulent or damaging activity to the Platform and/or third parties.
- 2.2. The User agrees not to use the Platform to store, post, transmit, send, use, publish or distribute any material that consists of or is associated with any spyware, computer viruses and other malicious computer programs or is associated with spyware, computer viruses and other malicious computer programs.
- 2.3. Any use of the Platform in violation of the law, including violation of the Terms and/or the documents specified in clause 1.2 of the Terms, including violation of the rights and legitimate interests of third parties, shall result in inability to use the Platform, including its specific functions.
- 2.4. The User may be given the opportunity to provide access to the functionalities of the Platform to third parties. In this case, the User shall notify the third parties of the provisions of the Terms and the documents specified in clause 1.2 of the Terms. Actions (inactions) of third parties are controlled by the User without Gravity Field's involvement.
- 2.5. The User gives Gravity Field and its affiliates consent to the processing of the User's personal information as such term is defined in the Privacy Policy https://gravityfield.ai/privacy-policy/, as well as consent to the processing and transfer of personal data of the third parties specified in clause 2.4 of the Terms for the purposes of using the Platform, including its specific functions, as well as for the purposes and to the extent provided by law, including for the purposes of exercising the rights and legitimate interests of Gravity Field and third parties.
- 2.6. The User hereby notifies, understands and agrees that Gravity Field may collect statistical data on the use of the Platform.
3. Other Conditions.
- 3.1. The Platform is provided on an "as is" basis without any warranties of any kind whatsoever, and all express, implied and/or statutory warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement, as well as any warranties regarding security, reliability, timeliness, accuracy, and performance of the Platform, are all expressly disclaimed to the fullest extent permitted by law. Gravity Field does not warrant that the Platform will operate error free or without interruption or bugs. Without derogating from the generality of the above, Gravity Field makes no warranties, representations or other affirmation of fact, including but not limited to statements regarding suitability for use with third party products or performance of the Platform.
- 3.2. Gravity Field shall not be liable for any direct or indirect consequences of any use or inability to use the Platform and/or losses caused to the User and/or third parties as a result of any use, non-use or inability to use the Platform or its individual components and/or functions, including due to possible errors or failures in their operation.
- 3.3. Gravity Field shall have the right to set any limits and restrictions on the use of the Platform, as well as the right to change them at its sole discretion, without prior notice to the User.
- 3.4. Gravity Field may, at its sole discretion, limit or completely block the User's access to use the Platform (or to use certain functionalities of the Platform, if technologically possible) in case of violation of these Terms and/or other documents specified in clause 1.2 of the Terms, or apply other measures to the User in order to comply with legal requirements, rights and legitimate interests of Gravity Field and third parties.
- 3.5. Gravity Field may, at its discretion, without notice to the User and without giving any reasons, block access of the persons specified in clause 2.2 of these Terms and Conditions at any time.
- 3.6. All questions and claims related to the use/inability to use the Platform, as well as possible violation of the law and/or rights of third parties, should be sent to the e-mail address support@gravityfield.ai.
