Gravity Field Platform
1. General Provisions
- 1.1 This Privacy Policy (hereinafter - the Policy) applies to all information, including personal data within the meaning of the legislation of the United Arab Emirates (hereinafter - "Personal Information"), which Gravity Field - FZCO (License number 32348), hereinafter referred to as "Gravity Field", may receive from a person using any website under Gravity Field administration or a person using the Gravity Field website, Platform (hereinafter - User, website, Platform).
- 1.2 The User who has started using the website, Platform, including the use of its individual functions, shall be deemed to have accepted the Policy without any reservations or exceptions and to have consented to the collection and use of Personal Information by Gravity Field, as well as to the receipt of Personal Information from the persons specified in clause 1.3 of the Policy.
- 1.3 Gravity Field may also receive Personal Information from its partners (hereinafter referred to as "Partners"), whose websites, programs, products or services the User uses, on the basis of special agreements with Partners and in accordance with the laws of the United Arab Emirates (hereinafter referred to as "applicable law").
- 1.4 Gravity Field does not verify the Personal Information provided by the User, except as provided for by the agreement between Gravity Field and the User and the applicable law. Gravity Field cannot judge whether the Personal Information provided by the User is accurate or whether the User has sufficient legal capacity to provide the Personal Information. Gravity Field assumes that the User provides accurate and sufficient Personal Information and updates it in a timely manner.
2. Categories of Personal Information
- 2.1 Gravity Field may collect the following categories of Personal Information about Users while using the website, Platform:
- 2.1.1 Personal Information provided during registration (account creation).
- 2.1.2 Electronic data (HTTP headers, IP address, cookies, web beacons/pixel tags, browser ID data, hardware and software information, wi-fi network data).
- 2.1.3 Date and time of access to the website, Platform.
- 2.1.4 Information about the User's activity while using the website, Platform.
- 2.1.5 Information on geolocation.
- 2.1.6 Other information about the User necessary for using the website, Platform.
- 2.1.7 Information about the User that Gravity Field receives from Partners in accordance with the terms of agreements concluded between the User and the respective Partner and agreements concluded between Gravity Field and the Partner.
- 2.1.8. Payment information provided by the User, as well as received from Partners or other persons involved in a payment transaction in connection with the provision of paid services by Gravity Field.
- 2.1.9 Cookies and web beacons (including pixel tags) to collect Personal Information and link such Personal Information to the User's device and web browser.
- 2.1.10 Gravity Field does not collect data for the purpose of compiling a "portrait" of the User to the extent that it may materially affect the User's rights and freedoms under the applicable law.
3. Purposes of Processing Personal Information
- 3.1 Gravity Field processes Personal Information if there are sufficient legal grounds to do so and only if:
- 3.1.1 Processing is necessary for the use of the website, Platform by the User.
- 3.1.2 Processing is necessary for Gravity Field to comply with its obligations under the applicable law.
- 3.1.3 Processing is necessary to ensure the legitimate interests of Gravity Field, provided that such processing does not significantly affect the interests, rights and freedoms of the User.
- 3.1.4 Processing is necessary for the purpose of improving the User's interaction with the website, Platform.
- 3.1.5 Processing is necessary for the purpose of offering other Gravity Field products or other companies that Gravity Field believes may be of interest to the User.
- 3.1.6 For specific purposes or in accordance with the requirements of the legislation of the applicable law, Gravity Field may request a separate consent of the User to the processing of Personal Information.
4. Procedures and conditions for Processing Personal Information
- 4.1 Gravity Field shall process Personal Information in accordance with the following principles:
- 4.1.1 The processing of Personal Information is carried out applicable law on fair basis and is limited to the achievement of specific, predetermined and legitimate purposes;
- 4.1.2 The content and scope of the Personal Information processed corresponds to the stated purposes of processing, Gravity Field does not process excessive personal data;
- 4.1.3 Ensures that measures are taken to remove or clarify incomplete or inaccurate data;
- 4.1.4 The Personal Information shall be stored in a form that allows to identify its subject and not longer than required by the purposes of processing, unless the storage period is established by applicable law or this Policy;
- 4.1.5 The processed Personal Information shall be destroyed upon achievement of the processing purposes or in case of loss of necessity to achieve these purposes, unless otherwise provided for by applicable law.
- 4.2 Gravity Field shall process Personal Information on the terms and conditions specified by applicable law, namely:
- 4.2.1 Processing of Personal Information is carried out with the User's consent, is necessary to achieve the purposes provided by applicable law, to implement and fulfill the functions, powers and duties assigned to Gravity Field by applicable law;
- 4.2.2 The processing of Personal Information is necessary for the execution of a contract to which the User is a party, beneficiary or guarantor;
- 4.2.3 The processing of Personal Data is necessary to exercise the rights and legitimate interests of Gravity Field or third parties, or to achieve socially important purposes, provided that the rights and freedoms of the User are not violated;
- 4.3 Gravity Field performs the following actions with Personal Information: collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), blocking, deletion, destruction.
- 4.4 Gravity Field receives the User's Personal Information in the following ways:
- 4.4.1 Personally from the User;
- 4.4.2 From the concluded contract, one of the parties of which is the User.
- 4.5 The User, who has provided Gravity Field with his/her Personal Information, consents to its processing by means of free will in the form required by applicable law.
- 4.6 If there is no need to obtain the User's written consent to the processing of his/her Personal Information, the User's consent may be given by the User or his/her representative in any form allowing to confirm the fact of its receipt.
- 4.7 Gravity Field has the right to disclose User's Personal Information in the following cases: in accordance with the requirements of applicable law, in response to the requirements of public authorities, in accordance with the requirements of legal proceedings in connection with the administration of justice, in case of necessity to protect the life, health or other vital interests of the User, in order to protect Gravity Field's rights or reduce possible damage to Gravity Field, in emergency situations.
- 4.8 If Gravity Field entrusts the processing of Personal Information to a third party, Gravity Field shall enter into an agreement with such third party. In such an agreement, Gravity Field shall oblige the person processing Personal Information to comply with the principles and rules of Personal Information processing stipulated by this Policy and the applicable law.
- 4.9 To ensure the protection of Users' Personal Information, Gravity Field has implemented the following measures: a person responsible for organizing the processing of Personal Information and its protection has been appointed; a Personal Information protection system has been implemented in accordance with the requirements of applicable law; all carriers with Personal Information, both paper and electronic, are subject to record keeping and strict storage and destruction requirements; all Personal Information is backed up and, in case of modification or destruction, Gravity Field can always restore it, except in cases of withdrawal of consent to processing by the User; access to Personal Information is available to the minimum number of Gravity Field employees and only for the purpose of performing their duties; the conditions of access to Personal Information are as follows.
5. Protection of Personal Information
- 5.1 By this Policy, Gravity Field informs the User that the User has no obligation to provide Gravity Field with any Personal Information, and such provision is based solely on the User's free will.
- 5.2 By using the website, Platform, including by using its individual functions, the User confirms that he/she realizes that without providing Personal Information Gravity Field will not be able to provide the User with the opportunity to use the website, Platform and voluntarily agrees to the transfer and processing of Personal Information by Gravity Field.
- 5.3 In most cases, Personal Information is processed automatically without access to it by any of Gravity Field's employees. In the event that such access is required, it may only be granted to those Gravity Field employees who need it to perform their tasks. To protect and ensure data privacy, all Gravity Field employees follow internal policies and procedures regarding the processing of Personal Information. They also follow all technical and organizational security measures in place to protect Users' Personal Information.
- 5.4 Gravity Field has implemented sufficient technical and organizational measures to protect Personal Information from unauthorized, accidental or unlawful destruction, loss, alteration, misuse, disclosure or access, and other unlawful forms of processing. These security measures have been implemented taking into account the current state of the art, the cost of their implementation, the risks associated with the processing and the nature of the Personal Information.
6. Place and period of storage of Personal Information
- 6.1 Personal Information is stored in the United Arab Emirates using databases located in the United Arab Emirates.
- 6.2 Gravity Field stores Personal Information for as long as it is necessary to fulfill the purpose for which it was collected or to comply with the requirements of the applicable law.
- 6.3 The User may delete his/her Personal Information from the website, Platform databases independently through the Platoform interface (if applicable) or with the help of Gravity Field at the User's request.
7. Rights of the User
- 7.1 The User has the right to access his/her Personal Information processed by Gravity Field in accordance with this Policy.
- 7.2 If the User believes that any information that Gravity Field stores about the User is incorrect or incomplete, the User has the right to correct the Personal Information independently by sending an e-mail to unsubscribe@gravityfield.ai or through Platform interface (if applicable).
- 7.3 The User has the right to withdraw consent to the processing of his/her Personal Information
- 7.4 The User has the right to request deletion of his/her Personal Information or any part thereof, restrictions on processing of Personal Information by sending an e-mail to unsubscribe@gravityfield.ai.
- 7.5 The User has the right to withdraw consent to the processing of his/her Personal Information by sending the withdrawal to the e-mail address unsubscribe@gravityfield.ai.
- 7.6 In cases stipulated by the applicable law, the User may have other rights not specified in the Policy.
8. Updating the Policy
- 8.1 The Policy may be amended. Gravity Field has the right to make changes at its own discretion, including, but not limited to, in cases when the relevant changes are related to changes in the applicable law, as well as when the relevant changes are related to changes in the operation of the website, Platform.
- 8.2 Gravity Field undertakes not to make any material changes, impose any additional encumbrances or restrictions on Users' rights set forth in the Policy without notifying Users. Users shall be notified of forthcoming material changes on the Gravity Field website before such changes take effect. Changes shall come into effect at the time of publication of the revised Policy on the Gravity Field website.
